Current position on the CIL Examination

7 JUNE 2018: Inspector's Reports received on the Examination of the Cotswold District Local Plan 2011- 2031 and Community Infrastrcuture Levy Draft Charging Schedule:

Inspector’s report on the Examination of the Cotswold District Local Plan 2011-2031

The Council received the examining inspector’s report on the submitted Cotswold District Local Plan 2011-2031 (“the Plan”) on 5th June 2018. The submitted Plan included the Submission Draft June 2016; Focussed Changes Addendum December 2016 and Minor Modifications Addendum June 2017.

The inspector’s report comprises two parts: 
(i) the main report, including a non-technical summary; and 
(ii) an appendix setting out detailed amendments (Main Modifications) to the Submitted Local Plan.

The inspector’s report concludes that the Plan, as submitted, provides an appropriate basis for the planning of the district provided that the Main Modifications, referred to above, are incorporated.

The Council will be recommended to adopt the Cotswold District Local Plan 2011-2031, incorporating the Main Modifications together with any Additional (i.e. minor) Modifications.  A special council meeting is being arranged for the near future and details will be made available on the Council’s website.

Inspector’s report on the Examination of the Cotswold District Community Infrastructure Levy Draft Charging Schedule

The Council received the examiner’s report on the submitted Cotswold District Community Infrastructure Levy Draft Charging Schedule on 5th June 2018.

The examiner’s report concludes the Cotswold District Community Infrastructure Levy Draft Charging Schedule, as submitted, provides an appropriate basis for the collection of the levy in Cotswold District.

The Council will be recommended to adopt the Cotswold District Community Infrastructure Levy Draft Charging Schedule although the levy is not likely to come into effect before April 2019; further information and a timetable will be provided later this year. A special council meeting is being arranged for the near future and details will be made available on the Council’s website.

July 2017 - The Cotswold CIL Draft Charging Schedule October 2016 ('CIL') has been submitted to an independent examiner to carry out the Examination in conjunction with the Local Plan Examination.

CIL Inspector

In accordance with section 212 of the Planning Act 2008 (as amended) and the Community Infrastructure Levy Regulations 2010 (as amended), Cotswold District Council has appointed an independent person (“the Examiner”) to carry out an Examination of the Community Infrastructure Levy Draft Charging Schedule October 2016 (CIL001). The appointed Examiner is William Fieldhouse BA (Hons) MA MRTPI.  He will consider whether:

  • the Council has complied with all legal and procedural requirements in preparing the CIL draft charging schedule;
  • the draft charging schedule is supported by appropriate available evidence, including about the actual and expected costs of infrastructure and the economic viability of development across the area;
  • the proposed charging rates are informed by, and consistent with, the evidence;
  • the evidence shows that the proposed rates would not put at risk the overall development of the area as proposed in the relevant development plan; and
  • the draft charging schedule includes an appropriate map.   

William Fieldhouse has also been appointed to examine the Cotswold District Local Plan.  The Examinations will be carried out in parallel in so far as this is practicable, and all evidence submitted in connection with one examination will be taken into account in the other where relevant.  There is a separate Local Plan Examination website www.cotswold.gov.uk/lpexamination.

After the hearings have been formally closed, the Examination remains open until the Examiner's Final Report is submitted to the Council.  However, no further representations or evidence will be accepted after the hearing sessions unless this has been specifically requested by the Examiner.
